Honda Sued over Gas Mileage Claims

A woman in California has decided to haul Honda into small claims court in that state because she says that the company misrepresented how much mileage she would get while driving her Civic hybrid. The advertisement for the car suggests that they will get an average of fifty miles per gallon but the woman has said that she never got that much mileage and that the mileage started to tumble down a lot after the battery started getting older.

The interesting thing about the case is that the woman who decided to bring it already opted out of a class action lawsuit being hurled at the company already because she feels she would be more apt to get what she deserves for payment by doing it on her own in small claims court. And some legal advisors have suggested that the woman might be right in her attempts to obtain money from the company due to her belief that the Honda parts did not function as they should have and as the company advertised they would.

One of the differences in small claims court versus what might happen in a class action lawsuit is that the people involved in the suit are not allowed to retain lawyers. One of the reasons why the woman decided not to be a part of the class action lawsuit is because the lawyers would have gotten over eight million and she would have gotten just a hundred dollars as part of the payment that would have been given to each participant.
